Review and Improvement of the Victim’s Right to Protest

Abstract

China's Criminal Procedure Law stipulates that victims enjoy independent status as litigants, but victims only have the right to protest, not the right to appeal. Based on the reality of the victims' right to protest, we can establish a limited right of appeal for victims as a consensus, and make basic definitions from the scope of objects, the scope of subjects, and the period of exercise. At the same time, we should set up pre-procedures, improve procedural transformation, conduct substantive review of the victims' reasons for appeal, and then protect the exercise of the victims' limited right of appeal through the improvement of the right to know and litigation agency system.
