Research on the Criminal Trial in Absentia System

Abstract

The 13th National People's Congress Standing Committee of China passed the system of trial in absentia in the Criminal Procedure Law. This marks that China has formally established the system of trial in absentia. It shows the importance attached to the system of trial in absentia. It also begins a new journey of trial in absentia in China. For a long time, China has adopted a relatively single system of ad hoc meetings. The establishment of a new trial system is a major test for China's judicial system. Therefore, it is necessary to continuously summarize new experiences from practice and improve them to accelerate the process of China's rule of law construction.
