Thinking on the Practice of Procuratorial Public Interest Litigation System in China and Its Optimization Strategy

Abstract

The public interest litigation system is a judicial relief system designed to protect the legitimate rights and interests of citizens and punish violations of the public interest. Since its introduction in 2005, it has made some achievements, but it has also encountered many difficulties in practice. With the rapid development of society, the emerging judicial system of public interest litigation is also facing many challenges, including the lack of effective legal support, the understanding of this needs to be in-depth, the lack of a clear definition of the rights and obligations of public interest litigation, and the lack of effective enforcement of judicial procedures. Therefore, we proposed to expand the application of public interest litigation, clarify the status and functions of procuratorial organs, improve legal provisions, create a good external environment, and other measures, to make more efforts in this regard, to promote judicial reform better. This paper analyzes the current situation in the practice of the public interest litigation system and the causes of the difficulties encountered. It puts forward feasible measures, hoping to put forward effective solutions for China's public interest litigation system.
